Identification<\/h2><p>Ferrer Wines, in compliance with Law 34\/2002, of 11 July, on Information Society Services and Electronic Commerce, informs you that:<\/p><ul class=\"wp-block-list\"><li>Its company name is: CAVAS J HILL, SL.<\/li><li>Its trade name is: Ferrer Wines.<\/li><li>Its Tax ID (CIF) is: B65725517.<\/li><li>Its registered office is at: CALLE BONAVISTA, 2 &#8211; 08734 Moja &#8211; Ol\u00e8rdola &#8211; BARCELONA (SPAIN).<\/li><li>It is registered with the Companies Registry of BARCELONA, Volume 43013, Folio 102, Sheet B-417866, 1st Entry.<\/li><\/ul><p>Ferrer Wines holds the following administrative authorizations:<\/p><ul class=\"wp-block-list\"><li>Authorization No. RSIPAC 40.07757\/CAT, granted by the Generalitat de Catalunya for the exercise of its activity, the supervisory body being the Departament de Salut.<\/li><li>Authorization No. RSIPAC: 30.00409\/B, granted by the Generalitat de Catalunya for the exercise of its activity, the supervisory body being the Departament de Salut.<\/li><\/ul><h2>2. Communications<\/h2><p>To contact us, we provide the following means of contact:<\/p><ul class=\"wp-block-list\"><li>Phone: 938900588.<\/li><li>Email: marketing@ferrerwines.com.<\/li><li>Postal address: CALLE BONAVISTA, 2 &#8211; 08734, Moja &#8211; Ol\u00e8rdola, Barcelona.<\/li><\/ul><p>All notifications and communications between users and Ferrer Wines will be considered effective, for all purposes, when made through any of the means detailed above.<\/p><h2>3. Products<\/h2><p>The products offered, together with their main characteristics and price, appear on screen.<\/p><p>Ferrer Wines reserves the right to decide, at any time, the products and\/or services offered to Customers. Accordingly, Ferrer Wines may, at any time, add new products and\/or services to those currently offered. Likewise, Ferrer Wines reserves the right to withdraw or stop offering, at any time and without prior notice, any of the products offered.<\/p><p>All of this is without prejudice to the fact that the purchase of certain products may only be made through the USER&#8217;s subscription or registration, whereby Ferrer Wines grants the interested party a username and password that will identify them and personally enable them to access the products.<\/p><p>Once inside <a href=\"https:\/\/ferrerwines.com\/\">www.ferrerwines.com<\/a>, and to access the purchase of the different products, the User must follow all the instructions given in the purchasing process, which entails reading and accepting all the general and specific terms set out on <a href=\"https:\/\/ferrerwines.com\/\">www.ferrerwines.com<\/a>.<\/p><h2>4. Availability and Substitutions<\/h2><h3>Products<\/h3><p>Ferrer Wines aims to guarantee the availability of all products advertised through <a href=\"https:\/\/ferrerwines.com\/\">www.ferrerwines.com<\/a>. However, if any requested product is not available or is out of stock, the customer will be informed via their email account as soon as possible.<\/p><p>If the product is not available, and the consumer has been informed of this, Ferrer Wines may supply a product with similar characteristics at no additional cost, in which case the consumer may accept or reject it by exercising their right of withdrawal and termination of the contract.<\/p><p>In the event of unavailability of all or part of the order, and the customer&#8217;s rejection of substitute products, the refund of amounts previously paid will be made using the same payment method used by the customer for the purchase.<\/p><p>If Ferrer Wines unjustifiably delays the refund of amounts paid, the consumer may claim double the amount owed.<\/p><h2>5. Purchase and\/or Contracting Process<\/h2><p>To make any purchase on <a href=\"https:\/\/ferrerwines.com\/\">www.ferrerwines.com<\/a>, the customer must be of legal age.<\/p><p>It will also be necessary for the customer to register on www.ferrerwines.com through a data collection form providing Ferrer Wines with the information necessary for the contract; such data must in all cases be truthful, accurate and complete regarding their identity, and the customer must expressly consent to it by accepting Ferrer Wines&#8217; privacy policy.<\/p><p>The steps to follow to make a purchase are:<\/p><ol class=\"wp-block-list\"><li>Select the products you wish to purchase.<\/li><li>Once finished, go to the cart to review your purchase.<\/li><li>Add or remove products from your cart.<\/li><li>Log into your user account or register if you do not have one.<\/li><li>Proceed to the payment and shipping process.<\/li><\/ol><p>The customer may view their previous purchases in their user account.<\/p><p>It is also advisable for the customer to print and\/or save a copy on a durable medium of the terms of sale when placing their order, as well as the receipt confirmation sent by Ferrer Wines by email.<\/p><h3>Invoicing<\/h3><p>Together with your order, you will receive the corresponding invoice.<\/p><p>To this end, the customer consents to receiving said invoice in electronic format. The customer will receive it at the email account used for the purchase. They may, at any time, revoke this consent by requesting it through customer service channels in order to receive the invoice on paper.<\/p><h2>6. Delivery<\/h2><h3>Products<\/h3><p>The order will be delivered to the address designated by the customer at the time of purchase, according to the chosen method.<\/p><p>The delivery area covers the following zones: mainland Spain, the Balearic Islands and the Canary Islands.<\/p><h3>Delivery Methods and Timeframes<\/h3><ol class=\"wp-block-list\"><li>By transport agency: The maximum delivery period is 5 business days.<\/li><\/ol><h2>7. Prices, Costs and Taxes<\/h2><p>The prices of the products listed on <a href=\"https:\/\/ferrerwines.com\/\">www.ferrerwines.com<\/a> will be expressed in Euros unless otherwise stated, and will be guaranteed during their period of validity, save for printing errors, regardless of the order&#8217;s destination.<\/p><h3>Products<\/h3><p>The final prices of all products (and, where applicable, the final prices per unit of measurement, when mandatory), together with their characteristics, offers, discounts, etc., are shown for each item appearing in the <a href=\"https:\/\/ferrerwines.com\/\">www.ferrerwines.com<\/a> catalogue.<\/p><ul class=\"wp-block-list\"><li>Products include VAT.<\/li><li>The VAT rate is 21%.<\/li><li>Shipping costs: Shipping costs are included for purchases of 60 Euros or more; for purchases below this amount, shipping costs will be 6 Euros.<\/li><\/ul><p>Product prices may change at any time. In such cases, the price applied will be the one in effect on the date the order is placed. In any case, the final cost will be communicated to the customer during the online purchase process before they finalize their acceptance.<\/p><h2>8. Payment Methods<\/h2><p>We offer the following payment methods:<\/p><ul class=\"wp-block-list\"><li>By credit or debit card: You can make immediate payment through our Bank&#8217;s secure SSL payment gateway. If any refund or order cancellation is required, the amount will be refunded via the same payment card.<\/li><li>By bank transfer: By cash deposit or bank transfer in favor of: Entity: Banco Bilbao Vizcaya Argentaria. Account number: ES09 0182 5424 5002 0850 7522. The customer&#8217;s name and order number must be indicated when making the transfer.<\/li><\/ul><h2>9. Returns and Withdrawal Policy<\/h2><p>As established by regulations, the consumer and user shall have the right to WITHDRAW from the contract within a maximum period of 14 calendar days without needing to state a reason and without incurring any cost, except as provided in articles 107.2 and 108 of Royal Legislative Decree 1\/2007, of 16 November, approving the consolidated text of the General Law for the Defense of Consumers and Users.<\/p><p>This right of withdrawal does not apply, among others, to:<\/p><ul class=\"wp-block-list\"><li>Contracts for the supply of products made to the consumer&#8217;s and user&#8217;s specifications, or clearly personalized, or which by their nature cannot be returned or may deteriorate or expire quickly.<\/li><li>The supply of alcoholic beverages whose actual value depends on market fluctuations.<\/li><\/ul><h3>Products<\/h3><p>The customer will have a maximum period of 14 calendar days from the day of receipt of the requested good or product to inform Ferrer Wines of their wish to withdraw from the contract.<\/p><p>Withdrawal implies that Ferrer Wines will proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment (provided the purchased product is not among the exceptions indicated above).<\/p><p>During this period, the consumer will inform the business of their decision to withdraw from the contract by completing the form available on the website.<\/p><p>Ferrer Wines will provide the consumer, on a durable medium, with an acknowledgment of receipt of said withdrawal.<\/p><p>To proceed with the return of a product, it is essential that it is in perfect condition and in its original packaging, with all its accessories and unused.<\/p><p>Once we receive your request, we will contact the customer to provide the details of the return.<\/p><p>The customer will bear the costs of returning the goods.<\/p><h2>10. Legal Warranty<\/h2><p>Products purchased through <a href=\"https:\/\/ferrerwines.com\/\">www.ferrerwines.com<\/a> have a warranty period of 3 years from the date of purchase, covering possible manufacturing defects in the product.<\/p><p>The customer must contact Ferrer Wines through customer service channels as soon as they detect a defect in the purchased products.<\/p><p>Deficiencies caused by improper use or handling, or defects arising from any external cause, are excluded from the warranty.<\/p><p>Ferrer Wines will be liable to the consumer or user for any lack of conformity existing at the time of delivery of the goods. To bring the goods into conformity, the consumer or user shall have the right to the replacement of the purchased goods that are the subject of the claim.<\/p><h3>Storage Tips for Our Products<\/h3><p>These storage tips do not exempt the manufacturer from its obligation to honor the legal warranty of products purchased by the consumer.<\/p><p>Wine evolves in the bottle. To uncork the wine at its optimal point of maturity, the following storage conditions are recommended:<\/p><ul class=\"wp-block-list\"><li>Humidity between 65-80%, avoiding odors, noise and electromagnetic fields.<\/li><li>Avoid movement and\/or vibrations, choosing a well-ventilated location. Bottles should be stored in a dark place, away from sunlight.<\/li><li>Constant temperature between 5\u00baC and 18\u00baC, with the optimal temperature being between 10\u00baC and 12\u00baC.<\/li><li>Still wines should be stored horizontally, while sparkling wines should be stored vertically.<\/li><\/ul><p>Once the product is on the market, a consumption period of 2 years is recommended.<\/p><h2>11. Liability and Exemption from Liability<\/h2><p>Ferrer Wines undertakes not to permit any transaction that is illegal, or that is considered by credit card brands or the acquiring bank to be capable of, or to have the potential to, damage their goodwill or negatively influence them.<\/p><p>The following activities are prohibited under card brand programs: the sale or offer of a product or service that does not fully comply with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also explicitly prohibited:<\/p><ul class=\"wp-block-list\"><li>The sale of alcoholic beverages to persons under 18 years of age.<\/li><\/ul><p>The consumer and user has the right to repair, replacement, price reduction or termination of the contract, in accordance with the provisions of Chapter II, Title IV, Book II of the General Law for the Defense of Consumers and Users.<\/p><p>If the product does not conform to the contract, the consumer may choose between repair or replacement of the product, both of which shall be free of charge for the consumer, and shall be carried out within a reasonable period of time depending on the nature of the products and their intended purpose.<\/p><p>If, following completion of the repair and delivery of the product, it remains non-conforming with the contract, the consumer may demand its replacement, a price reduction, or termination of the contract.<\/p><h2>12. Customer Service and Complaints<\/h2><p>To file any complaint or claim with Ferrer Wines, the customer must contact the customer service department.<\/p><p>In accordance with the EU Online Dispute Resolution in consumer matters and pursuant to Art. 14.1 of Regulation (EU) 524\/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform available at the following link: <a href=\"http:\/\/ec.europa.eu\/consumers\/odr\/\">http:\/\/ec.europa.eu\/consumers\/odr\/<\/a>.<\/p><h2>13.
